1. Terms of the StageYourIdea Platform
1.1 By using and registering on the StageYourIdea Platform, you consent to and are bound by these terms of use (the Terms). The Terms have an impact on your legal rights and obligations so we recommend that you read them carefully and diligently. If you are unwilling to be bound by the Terms, we urge you not to use the StageYourIdea Platform and suggest you to terminate any account you have created under the Platform. 1.2. We reserve the right to update the Terms at any time when deemed necessary based on our judgement. We may take this action based upon technical or legal criteria and factors or due to adaptation of the business to new needs and data processing. You agree that if you do not accept any adaptation to our Terms then you will immediately stop accessing and/or using the StageYourIdea Platform. If we have reasonable reasons to believe that a change to the Terms is substantial, we will notify all Registered Users via email elaborating on the change and the effective date of the change. Otherwise, the updated Terms will be in effect as soon as you gain accessibility to the Platform. It is your responsibility to review the Terms regularly so that you are informed about any changes that are applied from time to time.
1.3. How the StageYourIdea Platform operates
The StageYourIdea Platform is an online marketplace, accessed via the website www.stageyouridea.com (the “Platform”), where Venue Hosts can provide their Venue Services and Organizers can book for these Services. We do not directly offer Space Services, nor are we a party involved in transactions that take place on the Platform, nor does the Platform act as an agent for any party involved in transactions apart from facilitating payments. We are an intermediary Platform and we are not covenant to any type of contract that may occur at any time between an Organiser and a Venue Host.
Protecting your privacy is a priority for us. We encourage you to read our Privacy Policy to understand how we assemble, utilise and share information about your activity within the Platform as well as our Cookie Policy to comprehend what cookies we use on the StageYourIdea Platform and how you can handle cookies.
2. Definitions & Interpretation
2.1 The terms that have been defined in Condition 1 shall have the same meaning when used within the context of Terms. Furthermore, the undermentioned terms have the following meanings:
"Visitor": is a person who is not a registered user of the StageYourIdea Platform, and only has the ability to browse the website. The Visitor does not need to be logged in to the StageYourIdea Platform In order to to browse. Has the ability:
a. To see all the content and have access to all the available - publicly exposed - information and elements of the website,
b. To subscribe to the Platform’s newsletter so as to receive any type of notifications or updates and to communicate with the StageYourIdea team via [email protected].
"Registered Users": have all the benefits of a Visitor and can additionally:
a. Have access to features and functions - of a non-public nature - of the StageYourIdea Platform intended for and available exclusively to Registered Users,
b. Access, manage and update their personal accounts within the Platform,
c. Create listings, write comments, reviews and other content within the Platform and/or interact with other Registered Users of the Platform within the Platform,
d. Provide Spaces or make Space Bookings.
The StageYourIdea Platform is under no obligation to accept any individual or business as a Registered User and it is at our sole discretion whether to accept or reject any registration request. Additionally, StageYourIdea has the right to disable any account at any time, including - without limitation - if it is found to have violated the Platform Terms.
A Registered User can be either the Venue Host or the Organiser.
"Venue Host": any person over the age of 18 who registers as a user and creates an account on the StageYourIdea Platform as the owner or manager of a commercial or residential space in order to make it available on the StageYourIdea Platform for short-term rentals, to carry out activities such as events, meetings, productions of audiovisual content and/or other related or unrelated activities.
"Organiser": any person over the age of 18 who registers as a user and creates an account on the StageYourIdea Platform for the purpose of reviewing Spaces and making a possible short-term Booking of them for events, meetings, productions of audiovisual content and/or other related or unrelated activities.
"Space": any type of space (commercial or residential) that can be made available for short-term rentals for the purpose of organising events, meetings, audio-visual productions and/or other related or non-related activities.
"Space Service": the service expected to be provided by a Venue Host, including the availability of the Space.
2.1.1. Terms and words that are referred to in the singular include the plural and vice versa, those referred to in the plural include the singular.
2.1.2. The headings do not affect the interpretation of the Terms.
2.1.3. References to Conditions are references related to conditions of the Terms. The exercise of a right or remedy of a party may be without prejudice to all other rights and remedies of the party unless a right or remedy of a party is expressed as its exclusive right or remedy.
2.1.4. Any phrase introduced by the words "including" or "includes" shall be interpreted as indicative and shall not restrict the generality of the associated words.
2.1.5. The words "writting" or "written" refer to email.
“Content of the StageYourIdea Platform”: Anything including text, graphics, audio-visual material, information or any other material in digital form as well as the content that StageYourIdea makes available via the StageYourIdea Platform.
“User Content”: All content provided by the Registered User (Venue Host and/or Organiser) or authorised by him/her on the StageYourIdea Platform including texts, documents, images, photographs, reviews or copies, etc.
Acceptable Use Policy (AUP): our Policy that concerns Acceptable use of the Platform.
“Booking”: a reservation of Space Services agreed upon and made between an Organiser and a Venue Host based on the description and details written by each Venue Host in the Space listing of the Venue and the Services provided in the Space, which are available on the StageYourIdea Platform.
“Privacy Law”: any law and regulation of the European Union relating to the processing of Personal Data, including the General Data Protection Regulation (EU) 2016/679 of the European Parliament and the European Data Protection Board (GDPR).
“Fees”: the fee due from an Organiser to the relevant Venue Host in respect of a Booking.
"Services Agreement": the relationship between the Venue Host and the Organiser regarding the provision of Venue Services.
3. Registration and Use of the StageYourIdea Platform
3.1 If you want to register as a Venue Host on the StageYourIdea Platform, you must be at least 18 years of age and legally capable of entering into a contract. As a Platform we reserve the right to reject your registration. If you are registering on behalf of an organisation, you warrant that you are legally capable to bind the organisation you represent to these Terms.
3.2. All the details that you provide when registering on the StageYourIdea Platform must be true, accurate and complete. You agree to update your account in order for it to correspond with potential changes that you may apply regarding the aforementioned details or to contact us so as we can apply these desired changes. Upon our request, and at any given time, you ought to provide evidence of your compliance with this Term (3.2). You also agree to supply us with any further information we may request from you from time to time, including information relating to your identity. We may also verify the information you provide, by accessing the content you post on your social media account or otherwise. We may not accept your registration until we have confirmed the required information and we shall inform you accordingly.
3.3. By registering on the StageYourIdea Platform, you will create a password. You are responsible for keeping your password confidential. You are also responsible for any activity that occurs while using your account. Please take the necessary precautions to protect your password and contact us immediately via email at [email protected] if you believe there has been unauthorised use of your account. You may not transfer your account to anyone else. We may deny access to a password if we reasonably suspect that it is being used by an unauthorised person or that the user is violating the Terms.
4. Use and Availability of StageYourIdea Platform
4.1 If you wish to register as a Venue Host on the StageYourIdea Platform, you must be at least 18 years of age and legally capable of entering into a contract. As a Platform we reserve the right to reject your registration. If you are registering on behalf of an organisation, you warrant that you are legally able to bind the organisation you represent to these Terms. By registering, you agree not to:
4.1.1 attempt to gain unauthorised access to the StageYourIdea Platform or any other networks, servers or computer systems connected to the StageYourIdea Platform
4.1.2. fish or otherwise collect non-public information about another user that is registered on the StageYourIdea Platform (including email addresses), without first obtaining the written consent of its owner that you have the right to access such kind of information
4.1.3. add another user to your email address or mailing list without their consent after mandatory notification, or use another user's email address or contact information for purposes that are anti-social, destructive or cause any harm to other persons
4.1.4. transmit spam, chain letters or other unsolicited e-mail;
4.1.5. you access the StageYourIdea Platform with the intention of using any information, content or other know-how to create a competitive - with respect to the StageYourIdea Platform - Platform
4.1.6. reproduce, redistribute, sell, create derivative works from, decompile, or disassemble all or part of the StageYourIdea Platform to the extent expressly permitted by law and not subject to statutory exclusion.
4.2. We work to maintain and make the StageYourIdea Platform fully available at all times. However, we cannot rule out instances where access may be interrupted, including for scheduled maintenance or upgrades, for emergency repairs or due to failure of telecommunications connections and/or equipment. What we can do from our side in order to serve you and not hinder your activity within the Platform is to schedule the maintenance and upgrade process outside of normal working hours. However, you agree that we shall have no liability to you for any such interruptions. We are also not liable if you are unable to access the StageYourIdea Platform for any reason beyond your fault or ignorance, including your failure to use appropriate equipment or insufficient bandwidth of your internet connection.
5. Booking
5.1 Your communication within the StageYourIdea Platform with the Venue Hosts must be recorded and posted in a fair, honest and professional manner and must in any case comply with the Acceptable Use Policy of the Platform.
5.2 If you agree to purchase and the Venue Host agrees to provide the Services of the Space available, the terms of the booking apply and accordingly you warrant and represent to us that you will comply with the provisions of the booking. However, for the avoidance of doubt, you have the option not to make any Booking where the terms of the booking do not comply with the Platform Terms, in particular with regard to the payment of Space Service Provision charges. The Booking may be a written agreement or arranged through an exchange of emails.
5.3 As the Platform does not form part of the booking all issues, concerns and/or Questions regarding the Space Services should be raised with the Venue Host in the first instance.
5.4 We ask that you respect the property of others. You may use a Space booked through the StageYourIdea Platform only for lawful purposes. You, your collaborators and guests must not cause any damage to the Space where it took place or any disturbance to others. You must comply with all relevant policies set by the Venue Host for the Space provided to you. You should take out in force the appropriate liability insurance that you may take out in relation to a booking under these Terms.
5.5 We also ask Venue Hosts to comply with the Data Protection Legislation regarding your personal data. However, we cannot promise that they will. If you have any concerns about the use of your personal data by a Venue Host please contact the Venue Host directly.
5.6 You shall defend, indemnify and hold us harmless from and against any costs, losses, damages, expenses and liabilities that we may incur or arise as a result of any third party claim or class that may be brought against us by a Venue Host in relation to your own acts or omissions. By paying this compensation you avoid the termination of your account on the StageYourIdea Platform.
5.7 You and the Venue Host may cancel a Booking on the StageYourIdea Platform solely in accordance with the terms of the Booking and the cancellation policy communicated to you and disclosed by the Venue Host.
6. Booking Charges
6.1 You must agree with the Venue Host the terms of payment for the Fee. The final Fee agreed upon may differ from the Fee advertised for the respective Space on the StageYourIdea Platform. You have the possibility to pay for the Space Reservation by direct agreement with the Venue Host.
7. Intellectual property - right of ownership
7.1 The StageYourIdea Platform is owned and operated by STAGEYOURIDEA L.P.. The visual interfaces, graphics, design, collection, information, computer code, products, software, services and all other elements of the Platform (“StageYourIdea Platform Content”) are protected by copyright and proprietary rights laws and applicable law. All StageYourIdea Platform Content is the intellectual property of STAGEYOURIDEA L.P.. All trademarks, service marks and trade names belong to STAGEYOURIDEA L.P.. You have the right to view, print or download excerpts from the StageYourIdea Platform solely for your own use in order to exercise your rights and perform your obligations under these Terms but for no other purpose than the aforementioned. You are otherwise prohibited from copying, editing, altering, reproducing, publishing, displaying, distributing, storing, transmitting, exploiting for commercial purposes, disseminating in any form or using the content of the StageYourIdea Platform without our permission.
7.2 When User Content is submitted to the StageYourIdea Platform, you grant STAGEYOURIDEA L.P.. a non-exclusive, perpetual, royalty-free, irrevocable and fully licensed right to use, modify, reproduce, adapt, translate, publish, create derivative works, distribute and display such User Content worldwide in any medium. You represent and warrant that you own or otherwise control all rights to your User Content; that the User Content is accurate; and that your use of the User Content does not violate these Terms and will not cause harm to any person or entity. You will indemnify STAGEYOURIDEA L.P. with respect to any claim arising out of User Content. STAGEYOURIDEA L.P.. may monitor and edit or remove any User Content at its sole discretion. STAGEYOURIDEA L.P.. bears no responsibility and assumes no liability for any User Content.
7.3 If you believe that any StageYourIdea Platform Content infringes your copyright, you may submit a notice to us at [email protected] that includes the following information:
7.3.1. a physical or digital signature of a person authorised to act on behalf of the owner of any exclusive right that is allegedly infringed;
7.3.2. identification of the content (text, audio-visual, etc.) which is subject to copyright and which has allegedly been copied or
7.3.3. identification of the material (text, audio-visual, etc.) that is allegedly copied; to the extent we do not already have, sufficient contact information to enable us to contact you, including your name, email and/or postal address ·
7.3.4. a statement that you have a good faith belief that use of the material within the StageYourIdea Platform is not authorised by the copyright owner, its agent and/or the law
7.3.5. A statement that the information set forth in the notice is accurate and, under penalty of perjury, you are authorised to act on behalf of the owner of the exclusive right that is allegedly infringed.
8. Disclaimer - We specifically draw your attention to this Agreement
8.1 You acknowledge and agree that the StageYourIdea Platform is provided solely for informational purposes and to facilitate communication between the Venue Hosts and the Organisers. It is entirely your responsibility to ensure that a Space is suitable for your purposes and to properly communicate those purposes to the Venue Host.
8.2 We do not guarantee or represent that any Venue Owner will agree to provide the Services it describes in its listing to you or that you will find any Space or Services suitable for the purposes of the activities you intend to undertake.
8.3 We do not guarantee:
8.3.1 the suitability of a Space and/or the Services provided in the context of conducting activities (events, meetings, content production, etc.) in it;
8.3.2 the accuracy of any description of the Space, and/or the demonstration of the appropriate behaviour of any Venue Host in the context of a Booking.
8.2.3. the demonstration of appropriate behaviour by any Organiser in the context of a Booking.
8.2.4. We shall not be liable for any act or omission by the Venue Host or in relation to the Space Services provided by him or any other failure by the Venue Host to perform any of the Space Services he has promised to provide or expected to provide.
8.4 Our content is made available for informational purposes only. You should not rely on it as advice or encouragement.
8.5 In no event shall we be liable for a contract entered into in tort (including negligence) or otherwise for any:
8.5.1. loss of profit, anticipated profits or failure of any commercial activity;
8.5.2. loss of data and content, including contact information you have entered within the StageYourIdea Platform;
8.5.3. loss of opportunity
8.5.4. loss of revenue or wasted expenditure;
8.5.5. loss of reputation or customership; and/or consequential, special or incidental loss or damage.
8.5.6. We shall be liable to you only for direct losses arising as a result of the Platform's own breach of the StageYourIdea Platform Terms or our negligence; our maximum liability to you whether in contract, tort or otherwise shall not be in any case it exceeds in consideration the Fee we received for viewing the Space Services that are the subject of the claim or if there are no Space Services as the subject of the claim, the upper limit of the consideration amounts to €240.
8.6 Nothing in the Terms shall be omitted to exclude or limit our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation or for any other liability which cannot be excluded under Greek law.
9. Circumvention
9.1 If you maintain an account on the StageYourIdea Platform, then you may only make a Booking for the Space Services with the relevant Venue Host through the StageYourIdea Platform while you maintain that account and for 12 months after your account is terminated for any reason.
9.2. Any breach of Condition 9 constitutes a material breach of the Terms and we have the right to suspend or terminate your account claiming appropriate compensation for any damage caused by you.
10. Removal or Suspension
10.1 We may suspend or terminate your account on the StageYourIdea Platform at any time and without liability to you for any or no reason, in the event that:
10.1.1 any information you provide to us is untrue or we cannot verify or certify the authenticity of such information;
10.1.2. you violate any of the provisions of these Terms; and/or we receive complaints or disputes arise in connection with your activities on the StageYourIdea Platform.
10.2 Organisers may contact us at any time to cancel their account on the StageYourIdea Platform via our email address [email protected] by sending us an email with the relevant request.
10.3. After you terminate your account on the StageYourIdea Platform at your own initiative, any Reservation you made prior to the termination of your account will remain in effect. Those Venue Hosts (early Venue Hosts) who belong to the group of users that received free-of-charge presentation (photo shoots & 3d tour) would own to the platform for the time and effort of the team to list their Spaces, a fee of 2 euros per square metre.
10.4 After we terminate your account, you must stop using the StageYourIdea Platform and you must not attempt to re-register on the StageYourIdea Platform using any other name.
11. Login
11.1 You may link to our Home Page, provided you do so in a manner that is fair and legal and does not damage or take advantage of our reputation. However, you should not create a link in such a way as to suggest any form of association, endorsement or acceptance by us in our absence. You should not link from any website that is not yours. Our website must not be framed by any other website, nor may you link to any part of our website other than our Home Page. We reserve the right to revoke your login permission without notice. The website from which you are linking must comply in all respects with the content specifications set out in these Terms.
11.2. The website may contain links to refer to other websites and resources provided by third parties. These links are provided for your information only, we have no control over the content of these websites or sources and accept no responsibility for any loss or damage that may arise from your use of them.
12. General
12.1. There is no joint venture, partnership, employment or employment relationship between you and the Platform that arises as a result of your use of the StageYourIdea Platform.
12.2. The Terms (as amended from time to time) constitute the entire agreement relating to your use of the StageYourIdea Platform.
12.3. If any Term is found by a competent court to be invalid, voidable or unenforceable, then that Term will be invalid, voidable or invalid only to the extent of the relevant provision, without this affecting the validity of the remaining Terms.
12.4. If we do not promptly insist that you act under the StageYourIdea Platform Terms or if we delay in taking action against you in relation to any breach, this does not mean that you do not have to act under the StageYourIdea Platform Terms and this will not prevent us from taking action against you at a later date.
12.5. You may not assign, delegate or otherwise transfer your account or your obligations under the Terms without our prior written consent. We may assign or otherwise transfer our rights and obligations with respect to the Terms to third parties.
12.6. Any notice to you by email, regular mail or notice or links on the StageYourIdea Platform is acceptable notice to you under the Terms.
12.7. Any provision of these Terms that is expressly or impliedly intended to take effect or continue in effect after the termination or expiration of these Terms will remain in full force and effect. Any rights, remedies, obligations or liabilities of the parties that have accrued up to the date on which such provision is repealed, including the right to claim damages in respect of any breach of the Terms that existed prior to the date on which such provision is repealed, shall not be affected.
12.8 The Terms shall be governed by and construed in accordance with Greek law and you agree to submit to the exclusive jurisdiction of the Courts of Thessaloniki.
13. Subscription Services Definitions:
"Subscription" means the subscription purchased by a Venue Host that entitles the Venue Host to access the Subscription Services provided by the StageYourIdea Platform.
"Subscription Services" means the Services offered as part of a Subscription.
"Subscription Fees" means the subscription fees paid by a Venue Host to the StageYourIdea Platform for the Subscription Services provided by the Platform.
The "Initial Subscription Term" is the minimum duration of the Subscription Services.
The "Renewal Period" is a consecutive period following the "Initial Subscription Term", ending on the "Renewal Date".
The "Renewal Date" is the last day of the "Renewal Period".
"Advertised Price" is the price for which the Venue Host intends to provide Space Services.
14. General Provisions
14.1 The minimum initial subscription period (plan) required for all subscription packages is three (3) months, except for the twelve (12) month annual subscription.
14.2 The Venue Host will be invited to subscribe to a subscription package of his choice without asking for a credit/debit card. A free trial period of the subscription service of fourteen (14) days is provided after which if the StageYourIdea Platform has attracted interest / demand for the Space (2 booking requests) within that time a credit / debit card will be requested through ChargeBee in order to to purchase the subscription package selected by the Venue Host (1. "Beginner" or 2. "Advanced" or 3. "Professional" or 4. "Master") and the subscription will automatically renew on a monthly or annual basis, depending on the Renewal Period selected by the Venue Host when purchasing the Membership. In the event that it is not possible to attract two 2 booking requests within this time period (14 days) then the free trial period for the Venue Host will be extended until this condition is met. In the event that it happens earlier than the expiration of the time period that has been set, the purchase of any of the subscription packages will not be requested until the trial period of fourteen (14) days has been completed.
14.3 As an indication of attracting interest (by Organisers) is considered the act of purchasing Space Service of the Venue Host (booking request) and the acceptance of these requests by the Venue Host.
14.4 If you wish to cancel your plan, you must provide written confirmation 30 days before it expires. The Space Listing will then be removed from the StageYourIdea Platform after a period of 30 days.
14.5 We reserve the right to hide or remove Spaces from the StageYourIdea Platform in the event of outstanding accounts until the accounts are paid in full.
14.6 Potential Spaces under a subscription plan may be removed from the Platform if there is <90% response rate in less than 48 hours, with written warning and notification.
14.7 For users who have reached the exit page of their registration process on the StageYourIdea Platform the information they have stored in their registration record will be available for 30 days and reminder notifications will be sent to them to complete the purchase of a subscription plan as well as for purposes quality upgrade of the StageYourIdea Platform. They can change their consent from the login page at any time.
14.8. The Subscription Services become effective on the date the Member signs up for the Subscription Services. You will initially subscribe for the Initial Subscription Term and then the Subscription Services will automatically renew after each Renewal Period (monthly or annually) unless either party notifies the other party in writing of the impending termination of its subscription; at least 30 days prior to the end of any Renewal Period.
14.9 If the Venue Host wishes to terminate a Subscription before the end of the Renewal Period, or removes the Space it owns, from the StageYourIdea Platform before the end of the Renewal Period, the remaining unused period of the Subscription will be forfeited and the corresponding Subscription fees they will not be reimbursed.
15. Creating a Space Listing
15.1 Once you have been approved by the StageYourIdea team as a Venue Host, you can directly create a listing for a Space.
15.2 Venue Hosts may contact the Organisers when a reservation request is sent to them.
15.3. As Venue Hosts you acknowledge and agree that you are responsible for any Listing created through your StageYourIdea account and you accordingly warrant and represent that, in creating and maintaining any Listing:
15.3.1 You have the inalienable right to create the Listing and to offer, receive and provide Bookings for the Space you are offering on specified dates and time periods which are expressly stated in the Listing.
15.3.2. the Entry does not violate any agreement you have entered into with any third party
15.3.3. the Listing is accurate, complete and up-to-date.
15.4 A Venue Host may amend or update a Listing at any time prior to entering into any agreement with an Organiser based on that Listing and are always subject to the Listing Approval process followed by the StageYourIdea Platform. Unless otherwise agreed between the Venue Host and the Organiser, the Agreements based on a particular Listing will incorporate that Listing as constituted at the time the Request is sent by the Organiser, regardless of any subsequent amendment, update or withdrawal.
15.5. A Venue Owner must enter the Publicly Advertised Selling Price of their Space on the StageYourIdea Platform for their Space. The Advertised Space Price on the StageYourIdea Platform can be displayed in one of the following four ways, always inclusive of VAT:
15.5.1 Hire Fee (daily / hourly rate): This 'from' pricing indicates the price at which the Space can be requested to Book by the hour and/or by the day. The Venue Host must publish accurate prices and it is not allowed to change the price once the Organiser has made the Booking. The Venue Host may update the price at any time (although such changes will not apply to Bookings confirmed under previous pricing) and may vary the price per day of the week or seasonal season by applying flexible pricing. Prices must not be higher than the price offered by the Space to customers addressed to the Venue Host outside of the StageYourIdea Platform.
15.5.2. Minimum Spend: This 'from' pricing indicates the price for which the Space can be booked based on a minimum charge for food and/or beverage consumption. The Venue Host cannot modify the Minimum Spend once the Organiser has made the Booking. The Venue Host may update the price at any time (although such changes will not apply to Bookings confirmed under previous pricing) and the price may vary either by day of the week or month of the year or bespoke periods implementing flexible pricing. The prices must not be higher than the price offered to customers addressed to the Venue Host outside the StageYourIdea Platform.
15.5.3. Price per person: This 'from' pricing indicates the price for which the Space can be booked per guest, per day or per session, or provision of a private catering catalogue. The Venue Host may update the price at any time (although such changes will not apply to Bookings confirmed under previous pricing) and the price may vary either by day of the week or by season using flexible pricing. The prices must not be higher than the price offered to customers addressed to the Venue Host outside the StageYourIdea Platform.
15.5.4 Price Upon Request (PUR): This option should be used as a last resort and only if the Venue Host does not wish to apply one of the above options. Please note that Spaces priced in this way are by default placed at the bottom (end) of the Search Page (below all other Spaces) regardless of the package selected by the respective Venue Owner.
15.6 A Venue Host shall provide and display the Advertised Price of each Space on the StageYourIdea Platform in a manner that is clear, accurate and not misleading in order to provide Organisers with sufficient information to make price comparisons and make informed choices.
15.7. Where an Advertised Price on the StageYourIdea Platform is indicative of a Space Rental Fee, Venue Hosts should indicate that this is indeed the case in the applicable Listing and, where applicable, clearly explain the variations that may apply and how which the Space Rental Fee will be calculated.
15.8. In all cases, the Advertised Space Price on the StageYourIdea Platform must comply with the StageYourIdea Low Price Guarantee, which is detailed as follows:
15.8.1. The Venue Host agrees to ensure that the Space is advertised on the StageYourIdea Platform at the lowest possible price which is no higher than that advertised or offered for the Space on the Venue’s website that the Venue Host may maintain or through its own marketing materials.
15.8.2. The Venue Host agrees to ensure that the Space is offered and reserved through an Agreement by the StageYourIdea Organisers at the lowest possible price which is not higher than that advertised or offered for the Space on the website that the Venue Host may maintain or through its marketing materials.
15.9 The StageYourIdea Platform reserves the right to choose how Listings are presented to visitors and/or users of the Platform, including the display of search results, the order and/or ranking of Listings, and/or rankings of search results based on optimised search and user experience factors, including without limitation:
15.9.1 pricing (including the Advertised Price selected by the Venue Host in section 15.5);
15.9.2 the search criteria of each user and/or his preferences,
15.9.3 the availability of the respective Space,
15.9.4 the cancellation policy/history;
15.9.5 compliance with response time service levels;
15.9.6 of the Space's response rate,
15.9.7 the response speed of the Venue Host,
15.9.8 and the number of outstanding (not rejected, not closed, not accepted) Booking requests.
15.10 As a Platform we have an algorithm which takes into account a number of factors to assess which Spaces may be promoted as suitable to Visitors and/or potential Organisers registered on the Platform (either by promoting those Spaces or displaying those Spaces as Search Page results in search of the respective Visitor and/or Organiser).
15.11 For new Spaces to be introduced to the Platform we will provide an initial push to start with better prospects. The main factors that determine which Spaces will appear as results in an Organiser's search on the platform are Spaces whose capacity, pricing, location and activity tags match the search criteria (filters) entered by the Organiser. Organisers can narrow their search scope by entering more search criteria. Also, they are not obliged to enter any criteria if they wish, thus widening their search field to all the Spaces of the Platform.
15.12 The Venue Host, provided he maintains an active account, has access to the following information regarding Bookings completed within the Platform:
15.12.1 the date of the event,
15.12.2 the number of guests,
15.12.3 at the time of the event,
15.12.4 the type of event,
15.12.5 the budget of the event
15.12.6 and any additional information recorded in the comments box. The comment box is not mandatory.
17. Treatment of Requests - Response Time
17.1 In order to ensure professional treatment of the Organizers, who want an immediate response to their requests, the booking requests have a time duration of 2 days (48 hours). The Venue Hosts are invited to respond (with a positive, negative statement or with a counter-proposal of day / time if the Organizer has declared his request time as being flexible) within this time frame, otherwise the requests will expire.
17.2 Those Venue Hosts who respond within 1 day (24 hours) will see their Spaces to gain a favorable ranking on the Search Results Page. The response time is publicly visible informing the Organisers of the treatment probability of their potential requests.
17.3 Four (4) requests that will be left to expire as unanswered will act as a proof of demand equal to attracting two (2) booking requests from the StageYourIdea Platform and the Venue Host will have to pay the Space subscription to remain otherwise his account will be suspended, with written warning and notification. In the latter case, if he will ever attempt to join the StageYourIdea Platform again the trial period of proving demand will not apply to his case and he will be asked to pay the amount he owes in current prices during the time he will express interest to rejoin.
17.4 If the Venue Host becomes a paying subscriber and allows four (4) requests to expire, with written warning and notice, in all of the Spaces linked to his account a new section will appear within his listings titled ‘Similar Spaces’ featuring listings of other Venue Hosts, until his attitude is improved.
17.5 If the Venue Host remains unresponsive, the Venue Host's account will be deactivated, with a written warning and notification. It will not be possible to rejoin the StageYourIdea Platform ever again.
17.6 An Organiser who submitted a request and it expired as unanswered, is able to submit a new booking request to the same Space again under the applicable conditions.
18. Declaring Availability Status
18.1 The Spaces are shown on the StageYourIdea Platform based on the dates and times that have been set as most probable available for Venue Hosts to accept potential booking requests.
18.2 During the process of responding to demand requests, the Venue Hosts are presented with the option of declaration of their Spaces' availability status. Where it is observed that a Space is continuously declared as being 'Unavailable', without its Venue Host giving a reasoning, and without proposing an alternative date / time for the requested activity to take place, the respective Space, with a written warning and notice, will get an unfavorable ranking on the Search Results Page until the Venue Host's response rate is improved.
18.3 If the Venue Host's response rate does not improve, by written warning and notice, in all of the Spaces linked to his account a new section will appear within his listings titled ‘Similar Spaces’ which will feature listings of other Venue Hosts, until his response rate gets improved.
18.4 If the Venue Host attitude remains unchanged, his account will be deactivated, with a written warning and notification, whether or not he has payed for a subscription. It will not be possible to rejoin the StageYourIdea Platform ever again.
